David is a driven, young attorney who started with the firm in the fall of 2022 with a focus on municipal law and litigation. The highlight of his young career has been his involvement in a high-profile federal case representing the interests of recreational fishers throughout Michigan.

He appreciates the fast-paced nature of his work and is especially proud of the relief his clients feel when they put their trust in his hands. Ross is thoughtful, and a straight talker, delivering an up-front perspective about the advantages and disadvantages of a client’s particular situation. Whether it’s major litigation or a minor legal matter, Ross knows every client’s case is the most important thing to them, so he treats it that way as well.

As part of the firm’s Municipal Practice Group, he provides expertise and responsiveness to public officials and clients as Township Attorney, Village Attorney, and City Attorney, and as counsel to County Drain Commissioners throughout Michigan, where he handles litigation in administrative, trial, and appellate courts.

John also taught Property Law, Civil Procedure, Torts, Professional Responsibility, Equity & Remedies, Secured Transactions as a professor at Western Michigan Thomas M. Cooley Law School.

James (“Jimmy”) contributes his knowledge of law to the firm’s Franchise, Corporate & Business, Trademark, Municipal, and Litigation practice groups. Jimmy focuses on serving franchise clients by drafting franchise agreements/documents and conducting extensive research to help ensure that those documents comply with applicable franchise laws. He also performs research and analysis to protect client brands when trademark and/or copyright infringement occurs.

Jimmy assists the firm in providing legal research and advice to municipal clients on issues relating to constitutional law interpretation, Freedom of Information Act, Open Meetings Act, COVID-19, and Zoning Board of Appeals decisions. He aspires to gain additional expertise to advise municipal clients in election law matters. Jimmy also has conducted research and written segments for several of the firm’s monthly Township Law E-Letters and Webinars.

Jimmy joined FSBR in 2020 as a summer associate/law clerk and became an Associate in November 2021. While attending law school, he worked for Fleming Yatooma and Borowicz, PLC in Bloomfield Hills, Michigan as a summer associate.

Jimmy has provided legal assistance to a non-profit corporation assisting children and low-income families and performed research and drafted proposed legislation for child welfare reform in the State of Michigan. He also has delivered meals to families in need, assisted and coordinated events for the elderly at a senior living facility, and walked and cared for dogs at an animal shelter while in college.

Theresa is responsible for ensuring that Fahey Schultz Burzych Rhodes PLC is presented positively and professionally to the legal community, including clients, the courts, bar associations, and several association partnerships.  She holds principal responsibility for preparing and finalizing RFP responses/proposals to new clients, developing marketing materials, writing press releases, and managing the firm’s website. Theresa works with attorneys to finalize all PowerPoint presentations and handout materials. She also takes charge of the firm’s submissions for the annual Best Lawyers and Super Lawyers nominations for attorneys.

Theresa manages the administrative tasks associated with participation and attendance at conferences sponsored by the MTA, MRA, MACDC, MWWA, and others, as well as workshops and seminars put on by FSBR. She works with attorneys and staff to assist with venue selection and reservations, registration, vendor/exhibit booth scheduling, door prize donations, and the ordering of merchandise, business cards, food and beverages, and entertainment.

Theresa publishes the firm’s Municipal Group monthly Township E-Letter and drafts marketing materials to promote the newsletter as well as related webinars and workshops. She also assists in publishing the quarterly “Legislative Update” for the Michigan Association of County Drain Commissioners (MACDC), and occasionally writes articles for this publication.

Theresa joined Fahey Schultz Burzych Rhodes in 2012 as a Legal Secretary and transitioned to the firm’s Marketing and Administrative Assistant in 2018. She particularly enjoys the variety of her work at the firm. She holds a Bachelor of Science degree in Business with a concentration in Legal Office Administration from Pensacola Christian College in Florida.

Outside of work, Theresa enjoys boating, playing the piano, traveling and visiting new places, and cheering for her son in football and basketball as a sports mom.

With over 40 years of experience as a practicing attorney, Bill has handled every legal issue municipalities are likely to encounter – and he remembers all of them. He is especially passionate about zoning and planning, annexation and detachment, intergovernmental cooperation, and public improvement projects.

Bill sees his job as fun – his experience, legendary memory, and his can-do attitude elevate his creativity in problem-solving. He knows that no matter how good his last solution was, there’s always another way to tweak it and make it more advantageous for his clients.

If you really want to motivate Bill, tell him that a project has “never been done before” or “can’t be done.” He’s had a history of firsts during his career, including the first detachment of territory from a city to a township, and most recently an annexation of land from one city to another. If there’s a way to do something, Bill will find it.

Bill’s work with public utility and energy companies has helped resolve every major change and controversy facing the natural gas and electric energy industries over the last 40 years. His work encompasses many of the nuts and bolts of public infrastructure projects, and his attention to detail is an essential part of the process. Cole is able to quickly analyze legal issues and simplify them for clients, outlining the what and why of government regulations.

Cole assists on drain and public projects from start to finish, working with professional engineers and utility, municipal, governmental, and private entities to research easements and flood claims.

The truth is important to Cole, even when it’s not what someone may want to hear. His ability to empathize with clients while explaining the reality of a particular situation helps all parties come to an understanding regarding the details of municipal work.

Cole joined FSBR in 2016 after serving as a law clerk for the firm. He also clerked for the Michigan Department of Insurance and Financial Services. While he was in law school, Cole was an intern for the Ionia County Prosecutor.

Stacy is general counsel for the Michigan Association of County Drain Commissioners, representing more than 40 drain commissioners on behalf of FSBR.

She is drawn to out-of-the-box thinking to help move ideas forward — though she’s also not afraid to say no — and she’s dedicated to being as timely and cost-efficient as possible in her work.

A practicing attorney since 1996, Stacy has more than a decade of experience representing clients on issues relating to stormwater and inland lakes and streams, working on projects involving county and intercounty drains, lake levels, lake improvement boards, sewer authorities, and county public works offices.

In addition to her expertise in drain and water law, Stacy has extensive real estate valuation experience. As a former Certified General Appraiser, she was licensed to appraise real property of any type of value in the state of Michigan. Her appraisal expertise has proven extremely beneficial for the firm’s eminent domain and tax tribunal cases.

Stacy joined FSBR in 2011 and has been a partner since 2013.

Chad assists the firm’s growing Municipal and Labor and Employment practice groups. He particularly focuses on the representation of municipalities in labor and employment matters, from negotiating collective bargaining agreements to assisting in the handling of employee disciplinary matters.

The rules and regulations that surround public sector labor and employment issues can be complex, but focusing on forward-thinking measures that prevent labor and employment issues from arising in the first place is essential. Chad regularly evaluates the employment practices of municipalities by working closely with elected public officials and by reviewing the effectiveness of employee handbooks and personnel policies to make sure they are in compliance with current labor laws.

Labor and employment issues can create unique challenges for municipalities due to the scrutiny of being in the public eye, which is why it is important to have dedicated legal counsel with a comprehensive understanding of governmental entities and the political environment in which they operate.  When labor and employment situations arise, Chad is dedicated to finding workable solutions to issues and informing clients of their best options for moving forward. Chad often drafts legal opinions providing clear answers to clients’ questions and concerns. When the need arises, Chad is there to vigorously represent his clients and fight for their best interests, whether it be in arbitration, negotiation, mediation, or even litigation.

Amanda practices in Michigan Drain Law and Environmental Law. She is dedicated to serving the needs of Michigan’s drain and water resources commissioners and lake improvement boards so, in turn, they can effectively serve their constituents. Amanda is well-versed in navigating the complex statutory procedures of the Michigan Drain Code and Parts 307 and 309 of the Michigan Natural Resources and Environmental Protection Act, which gives her the foundation to successfully counsel clients through difficult legal issues.

When it comes to project management, Amanda has expertise in coordinating with clients, governmental units, and professional engineers on complex public infrastructure projects, ensuring the legal aspects are met and followed through within projected timelines. Where project management and the practice of law interconnect, Amanda excels at producing successful results.

Amanda advises clients on several aspects of law related to drains, inland lakes, and natural resources. She has counseled clients on county and intercounty drain projects, including easement acquisition. She has facilitated buffer strip agreements and advised on wetland protection through wetland banking.  She has assisted clients with preparing for public meetings and hearings. Additionally, Amanda has helped clients establish legal lake levels and has also assisted in inland lake level and lake improvement proceedings. Notably, Amanda has been involved in moving legislation forward that will benefit modern-day drainage procedures.

The feedback and engagement that comes out of the process as regulations are created fuels Matt’s creativity, drive, and work ethic, and he is excited to be a part of crafting solutions to meet specific needs and has assisted several townships in the new area of marijuana ordinances.

The ordinances he drafts balance solutions that achieve municipal goals while offering a realistic approach to language and supports collaborative solutions for citizens, local businesses, and outside groups. He assists boards and commissions in moving projects forward, ensuring that stakeholders and partners are meeting their legal requirements, and finding solutions to common problems to facilitate successful projects. His expertise also extends to marijuana regulation and real estate transactions.

Matt is detail-oriented and agreeable, making him a natural with both research and committee work. He enjoys working with people from all backgrounds, and he’s proud of his ability to build trust and consensus quickly.

He joined FSBR in 2015 after working for the Michigan Court of Appeals, researching a wide variety of topics including administrative law, municipal law, and business litigation.

At home, Matt is dedicated to getting his four kids to bed on time, reading, computer gaming, and sampling a good Irish whiskey. His family also proudly supports the local special-needs community.

Michelle manages the day-to-day business functions and assists in the overall administration of the firm. She performs a variety of human resource management tasks, including hiring and professional development, onboarding, benefits enrollment, annual performance evaluations of all staff and attorneys, and establishing written policies and procedures for the firm. Michelle handles the firm’s invoicing, accounts payable, and accounts receivable. She is responsible for organizing and planning firm social events to maintain the firm’s culture and core values.

Michelle particularly enjoys the variety of her responsibilities and the internal knowledge she holds due to the evolution of her role. The culture contributes to her feeling like a valued and vested member within the firm.

Michelle joined Fahey Schultz Burzych Rhodes in 2008 as a Receptionist/Legal Assistant, transitioned to a Legal Assistant in 2010, and Office Manager in 2016. She holds a bachelor’s degree in Business Administration (magna cum laude) from the University of Michigan-Flint and an associate degree in Business, Legal Office Administration (magna cum laude) from Lansing Community College.

Outside of work, Michelle enjoys spending time with her family, particularly at their cottage on Elk Lake, traveling, and working on home improvement projects. She also likes to serve as a volunteer providing local families with Thanksgiving turkeys, non-perishable foods, personal hygiene products, clothes, and winter apparel.

Kaylin is responsible for assisting our Municipal and Labor and Employment practice groups by drafting, proofreading, finalizing, and filing legal documents, including agreements, opinions, ordinances, and legal pleadings. She communicates with court staff, clients, and opposing counsel to schedule/calendar events, coordinate deadlines, and submit case documents appropriately. She also assists multiple attorneys within the firm on their respective projects, which may involve responding to discovery requests, prepping for trial, and organizing electronic client files.

Kaylin especially enjoys the proofreading and research aspects of her role as they allow her to learn about a variety of topics and processes.

Kaylin joined Fahey Schultz Burzych Rhodes in February 2021 as a Legal Assistant. She holds a Bachelor of Science degree in Paralegal Studies (magna cum laude) from Eastern Michigan University.

Prior to the COVID-19 pandemic, Kaylin volunteered with helping set up for the City of East Lansing’s winter outdoor festival, “Winter Glow.” She also participated in workdays at Henry Fine Park removing invasive buckthorn and planting flowers.

Outside of work, Kaylin enjoys playing softball, golf, and tennis, as well as hiking, biking, and traveling, going to the beach, and spending time with friends and family.

Rhonda assists the attorneys in the Business Practice Group serve the day-to-day legal needs of their clients. In forming new companies, she is the go-to person for filing articles, obtaining EINs, drafting bylaws and operating agreements, and creating stock certificates. For business franchise engagements, Rhonda orchestrates the Franchise Disclosure Document registrations and renewals, as well as drafts Franchise Agreements. She is instrumental in putting together liquor license applications and completing the paperwork necessary for initiating criminal background checks. Rhonda’s wealth of practical experience enables her to assist every lawyer in the firm, including providing notary services as a notary public.

Rhonda most enjoys the working relationships she has formed with the people she works with, clients, and individuals at state agencies across the country.

Rhonda has been with Fahey Schultz Burzych Rhodes PLC since the firm opened in 2008. Joining the firm as a Receptionist and Legal Secretary, she served as a Paralegal/Legal Secretary from 2010 to 2018 and then was promoted to her current position as a Paralegal. Rhonda was awarded the NALS Legal Professional of the Year in 2010.

When not working, Rhonda enjoys watching football and basketball, reading, and tackling DYI home improvement projects.

Lizzie works in municipal law, labor and employment law, and general litigation, providing daily advice and counsel on the myriad issues municipalities and employers face.

Her municipal practice involves drafting and enforcing ordinances, preparing legal opinions, and addressing the issue du jour for the many townships with whom she works. Lizzie enjoys helping her clients solve problems and plan for success, and she understands the challenges of running the business of local government in the public eye.

Her labor and employment law practice focus keeps her busy, representing municipal and private sector management. The labor and employment practice in particular can be intensely personal and sometimes involves the tough realities of termination, but Lizzie strives to bring empathy to the table as she advocates for a legal resolution. Her affinity for interacting with people enables her to quickly dissolve conflicts. She also has the gift of an incredible memory, recalling details not only about problems she’s worked to solve but about the people involved. Relationships are critical in labor and employment issues; being able to recall professional and personal details off the top of her head is a real asset to her clients in labor negotiations and conflict resolution.

Lizzie has extensive experience in collective bargaining, grievance and interest arbitration, and administrative claims defense before the Equal Employment Opportunity Commission, Michigan Department of Civil Rights, state and federal wage and hour divisions, and others.

Lizzie joined Fahey Schultz Burzych Rhodes in 2010 and became a member in 2017. Prior to that, she served as a judicial extern to the Hon. Thomas L. Ludington, District Court Judge in the Eastern District of Michigan. While at Thomas M. Cooley Law School, Lizzie earned 11 Certificates of Merit, the highest honor for academic performance in a course.

When she’s not at work, Lizzie enjoys spending time with her husband and children; strives to read hardcover books ranging from mysteries to autobiographies of important figures in world history, to true crime to professional development theories; listening to an HR or true crime podcast; and enjoying the lake near their home year-round.

Brittany assists the firm’s growing Municipal and Drain Law Practice Groups. She concentrates on the representation of drain commissioners, townships, cities, counties, libraries, and special authorities served by the firm and provides support for the firm’s Labor and Employment Practice Group, researching and reviewing legal opinions and documents.

She’s proud to be part of a team that cares about its clients and wants to do the right thing. She enjoys helping her clients work through a challenging question or finding the answers they’re seeking. Her personal connection with clients and her commitment to honesty and integrity is important to her, and she enjoys the research and writing that goes into her work.

Brittany joined FSBR in 2019 following her time as an associate attorney with White Law PLLC. Her work included representing clients in a variety of areas including large civil litigation, criminal law, administrative law, general litigation, and driver license restorations. While in law school, Brittany was a judicial extern for Court of Appeals Judge Amy Ronanye Krause.

When she’s not at the office, Brittany is spending time with her husband, their two boys, and their dog. She also enjoys coaching the Haslett junior varsity girls’ basketball team.

Kyle assists FSBR’s growing Municipal Practice Group, concentrating on the representation of townships, cities, counties, libraries, and special authorities served by the firm and provides support for the Drain Practice Group.

Fact-finding, problem-solving, and brainstorming are among Kyle’s favorite parts of his work, and he enjoys crafting multiple ways to help clients tackle their challenges. He’s able to simplify complex problems so all parties can understand the work at hand, making it easier to devise practical solutions.

Kyle’s work focuses on public entities in need of advice on a wide variety of legal topics from the Freedom of Information Act to drafting purchasing policies. He actively listens, asking questions to determine how FSBR can solve their legal problems and identifying other issues and concerns clients may need to address.

Kyle joined FSBR in 2018 after spending the previous summer as a summer associate with the firm. During law school at the University of Notre Dame, he externed for the City of South Bend’s legal department and the Hon. Judge Jack Zouhary, U.S. District Court Judge of the Northern District of Ohio. He helped revise ordinances, review contracts, and aided in code enforcement and foreclosure matters.

In his free time, Kyle enjoys traveling and watching Michigan football and the Green Bay Packers. He’s a self-proclaimed terrible fisherman, though he enjoys it immensely.

• Responded to 2016 ballot “Emily” FOIA request for multiple municipalities.

• Prepared successful defenses for individuals with professional licenses in the Michigan Office of Administrative Hearings and Rules.

Stacy is responsible for assisting our Drain, Business Litigation, Michigan Tax Tribunal, and Energy practice groups by proofreading and finalizing all legal documents and correspondence; filing pleadings with courts/agencies; drafting pleadings and correspondence; assisting with special projects; corresponding with counsel, court personnel, and clients; and docketing and organizing internal files.

Additionally, Stacy is responsible for the onboarding of legal assistants and implementing and improving upon administrative processes. Stacy previously assisted the Municipal and Labor and Employment practice groups.

Stacy enjoys being part of the FSBR team which she describes as being passionate, reliable, hardworking, fun, and caring about each other and their clients.

Stacy joined FSBR in June 2020 as a Lead Legal Assistant after leaving the Michigan Attorney General’s Office.  She holds a Bachelor of Science degree (cum laude) from Western Michigan University.

Outside of work, Stacy enjoys being active and spending time with her four sons who are her greatest joy. She loves cheering on her two teenagers in football, basketball, track, and wrestling, as well as playing with her two toddlers. During the summer, you will find her poolside with her kids, in a boat on a lake, or playing sand volleyball.

Chris applies his affinity for solving complex, technical problems to his work in general municipal law, land use and zoning law, administrative law, civil and appellate litigation as well as commercial and residential real property issues. These experiences and skills enable Chris to capably manage matters — big and small — for his municipal clients and bring an extraordinary and informed insight into the judicial process.

He is focused on finding practical solutions to the issues faced by his clients that balance achieving effective, timely results while remaining cost-conscious. Chris takes pride in the creativity he employs to find alternative resolutions to his clients’ problems, and his efforts and protecting and navigating his clients through complex legal issues.

He is committed to a high level of perfection and responsiveness – his clients are his top priority.

Chris joined the firm in 2013. Prior to that, he served for two years as law clerk for the Hon. Lawrence P. Zatkoff, Federal District Court Judge.

Steve has practiced law since 1987, specializing in energy law, public utilities, and appeals.

Steve focuses on complex commercial and regulatory appeals, particularly utility regulation issues involving service and rates for electricity, renewable energy, natural gas, municipal water systems, and sanitary and storm sewers. He has been involved in extensive litigation before trial and appellate courts throughout Michigan, including some of the most significant utility and municipal cases before the Michigan Court of Appeals and Supreme Court.

He particularly enjoys writing briefs and managing complex litigation. His deep historical knowledge and understanding of regulatory and judicial processes, paired with an ability to identify the controlling issues and clearly explain to decision-makers the legal and policy support for positions are among his best assets to clients.

Since 1978, Steve has dedicated himself to the representation of municipalities across the state of Michigan and protecting the interests of employers in both the private and public sectors.

Steve’s practice focuses on the representation of cities, townships, libraries, and other local governments in a wide range of matters including those arising under the Home Rule Cities or township enabling statutes, the Open Meetings Act, the Freedom of Information Act, Michigan’s Public Employment Relations Act, the Downtown Development Authority Act and myriad other statutes affecting municipalities across the state.

Jake practices in the firm’s growing Municipal Practice Group, representing townships, cities, counties, libraries, and special authorities.

The trial work he does is quick and requires him to be nimble and prepared, and he enjoys that challenge. He also is drawn to unusual research projects for municipal clients, examining questions that haven’t been asked previously. The thrill of the chase down the rabbit hole is something he welcomes.

Jake’s work focuses on code enforcement and prosecuting civil infractions for ordinance violations. He assists in drafting new ordinances, sign regulation, and small cell licensing, and he researches novel areas of the law including amending zoning and nonzoning ordinances.

He prides himself on being a diligent worker who brings a level-headed, approachable demeanor to the table. He has high standards for the work he does, and he enjoys building personal connections with his clients.

Jake joined FSBR as an associate attorney in 2018 and was a clerk just prior to that. He was previously an intern for the Hon. John T. Gregg in the United States Bankruptcy Court for the Western District of Michigan, and an intern for the Hon. Rosemarie E. Aquilina in the 30th Circuit Court.

Outside of the office, Jake and his wife like to hike and camp in the U.P. and spend time at their family place in Harrison.

EXPERIENCE

• Drafted comprehensive regulations for small cell wireless facilities for the City of Fenton and the City of Niles in response to recent legislation and was a largely unexplored area of the law when I put these materials together.
• Successfully prosecuted ordinance violations in Lake Township, Roscommon County, Michigan.
• Completely overhauled several zoning ordinances for townships across the state. This is a massive undertaking as zoning ordinances are typically well over a hundred pages long with extensive cross-references; they also tend to vary immensely between municipalities, requiring each to be tailored to the individual needs of the client.
• Worked on various constitutional issues for municipalities involving first and second amendment rights, particularly in the regulation of shooting ranges and signs.

Mitchell is an associate attorney with Fahey Schultz Burzych Rhodes PLC, where he counsels clients in strategic approaches to achieve their goals. His practice focuses on general business law, franchising, intellectual property, as well as certain aspects of employment law that surround the business sector.

Mitch is dedicated to supporting all aspects of the client’s brand. He routinely conducts trademark clearance searches, prepares and prosecutes trademark applications, and manages the trademark registration process from beginning to end. When negotiating complex licensing and service agreements, he emphasizes communication and collaboration to arrive at a finished product that will not only meet the client’s needs and goals, but also mitigate risks. Mitch also regularly drafts legal memorandums and conducts legal research in his respective fields of practice.

Mitch joined FSBR as a law clerk in 2017 and became an associate with the firm in 2020. While attending law school, Mitch interned at the Legal Services of Eastern Michigan. He was also a member of the Trademark Moot Court Team, a teaching assistant, and served as a notes editor on the Editorial Board of the Michigan State Law Review.

Outside of the office, Mitch enjoys spending time in Northern Michigan at his family cottage on Houghton Lake. He also enjoys craft beer and visiting breweries around the state. As a true Michigan native, he is a loyal fan of the Detroit Lions, no matter the highs and lows that it brings.
