Understanding the New Overtime Rules

Presentation Overview:

The federal Department of Labor has changed the rules for paying employees overtime compensation. Learn which township employees are exempt from overtime, which ones are required to receive overtime pay, when they are required to get it, and how much overtime you must pay them. Make sure you don’t find yourself on the wrong side of a wage and hour investigation. 

Generally, a township must pay overtime compensation to an employee who works more than 40 hours in a workweek under the Fair Labor Standards Act (FLSA). Like nearly every rule, however, there are exceptions: 

  • Overtime is not due if the township can show that an employee meets both a minimum salary threshold and the minimum primary duty requirements. 
  • Salaried employees who meet or exceed a certain salary threshold may still be entitled to overtime. 
  • Law enforcement and fire protection personnel are not necessarily entitled to overtime pay if they work more than 40 hours is a given week.

Because we are being presented with new overtime rules in 2017, and there are many exceptions to the current overtime rules, you might find some useful information in this year's Overtime Rules presentation.
