Understanding Employment and Overtime Rules for Public Employees in 2017

At the 2016 Michigan Township Association Conference, Helen “Lizzie” Mills covered employment matters for public employees, including recruiting, hiring, retirement, discipline and termination. She talked about determining whether an employee is "exempt" or "non-exempt" for overtime pay, how an Unlawful Harassment policy can be useful for investigation of harassment claims, and how township law employees are not immediately eligible for family medical leave under the Family Medical Leave Act (FMLA).

Since the 2016 presentation on township employment law, the Department of Labor has adjusted eligibility requirements for overtime compensation in 2017. At the 2017 Michigan Township Association Conference, her presentation will focus on these changes in overtime compensation for public employees. The presentation will include:

  • The two-pronged test for overtime eligibility
  • How the two-pronged test is being altered by the Department of Labor
  • How compensatory time can be used to manage overtime, and how to use it properly
  • Why law enforcement and fire protection personnel are not necessarily entitled to overtime pay after working 40 hours per week
  • The impact that the new Presidential Administration may have on these new overtime rules
  • How a wage and hour investigation could have a major impact on a small township
